MoodDrafts (“we”, “our”, or “us”) respects the intellectual property rights of others and expects our users and editorial team to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (the “DMCA”), we will respond expeditiously to claims of copyright infringement committed using the MoodDrafts website (the “Site”) that are reported to our Designated Copyright Agent.
1. Short Phrases and Copyright Law
As a digital utility library, much of the content we curate consists of short phrases, common idioms, internet slang, titles, and blank templates. Under United States copyright law, short phrases and common expressions are generally not eligible for copyright protection. However, we do curate longer quotes, poems, and song lyrics. We review all takedown requests seriously to ensure we are operating within the bounds of the law and respecting original creators.
2. How to File a DMCA Takedown Notice
If you are a copyright owner, or are authorized to act on behalf of one, and you believe that your copyrighted work has been copied in a way that constitutes copyright infringement that is taking place through the Site, please submit a written notice to our Designated Agent. Your notice must include the following information:
- Your Signature: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identify the Work: Identification of the copyrighted work claimed to have been infringed (e.g., the name of the song, the title of the book, or a link to the original publication).
- Identify the Infringing Material: Identification of the material that is claimed to be infringing and that is to be removed. Crucial: You must provide the exact URL(s) on MoodDrafts where the content is located so we can find it.
- Your Contact Info: Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an email address.
- Good Faith Statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Accuracy Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Upon receipt of a valid and complete DMCA notice, we will take whatever action, in our sole discretion, we deem appropriate, which may include prompt removal of the challenged material from the Site.
4. Counter-Notification Procedure
If you believe that material you posted on the Site was removed by mistake or misidentification (for example, if you believe your use of a quote constitutes Fair Use), you may file a counter-notification with our Designated Agent. The counter-notice must include your signature, identification of the removed material and its previous location, a statement under penalty of perjury that the removal was a mistake, and your contact information.
5. Repeat Infringers
In accordance with the DMCA and other applicable law, MoodDrafts has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, any third-party content partnerships or user submission privileges (if applicable) of those who are deemed to be repeat infringers.
